Terms of Use

These Terms of Use govern your access to and use of the websites and account portal operated by The Waide Company LLC, an Idaho limited liability company (“The Waide Company,” “we,” “us,” or “our”), including:

These Terms do not govern the Waide Academy marketing site (waideacademy.com), the Academy application (app.waideacademy.com), or gameplay and educational features inside the Academy. Those are covered by the Waide Academy Terms of Use.

By using the Services described here, you agree to these Terms. If you do not agree, do not use them.

The Waide Company provides a public marketing website and a Waide account portal where you can create an account, manage your profile, purchase eligible products, and access account-level tools for Waide Company projects.

We may add, change, suspend, or discontinue features at any time.

You must be at least 13 years old to create a Waide account on account.thewaidecompany.com. You agree to provide accurate information and not impersonate others or create accounts for fraudulent purposes.

If you are under the age of majority in your state, use the Services with the knowledge and permission of a parent or legal guardian where appropriate.

You are responsible for your login credentials and activity on your account. Notify us at admin@waidecompany.com if you believe your account has been compromised.

A Waide account may be used across current or future Waide Company products you choose to access.

Some products may be available for purchase through the account portal. Payments are processed by third-party payment processors; we do not store full payment-card numbers.

By completing a purchase, you represent that you are authorized to use the payment method and that your billing information is accurate. If the purchase is for a child, you also represent that you are the parent, guardian, or otherwise authorized to act for that child.

Unless stated otherwise at purchase, sales are final except where required by law. Contact admin@waidecompany.com with purchase questions. We may correct pricing errors or cancel invalid transactions and provide refunds required by law.

Waide Academy is a separate educational product. Through your Waide account you may purchase Academy access, add an Academy Guardian role, or create and manage Cadet profiles. That account-level setup is part of the Services covered by these Terms and the Privacy Policy.

Using the Academy itself (including lessons, AI mentor dialogue, and progress inside the game) is governed by the Waide Academy Terms of Use and Privacy Policy at waideacademy.com, not by this document alone.

If you buy Academy access or set up a Cadet here, you still agree to the Academy terms and privacy notices when you or your Cadet use the Academy application.

Use the Services only for lawful purposes and in accordance with these Terms. You may not:

We may suspend or terminate access to the Services or your account if we reasonably believe you violated these Terms or applicable product terms, engaged in fraud or abuse, pose a security risk, lack required authorization, or if continued access could harm us or others. We may act with or without prior notice where permitted by law. Misconduct does not entitle you to a refund except where required by law.

You may request account deletion by emailing admin@waidecompany.com.

The Services and their content (including text, software, designs, media, and branding on the hosts covered by these Terms) are owned by The Waide Company or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable license to use the Services for personal, intended use under these Terms. No ownership is transferred to you.

If you submit feedback, survey responses, or suggestions through the Services, you grant us permission to use them to improve our products without compensation. This does not affect how we handle personal information under our Privacy Policy.

The Services rely on third-party providers (such as hosting, authentication, email, and payment processing). Their acts and policies are their own; your use may also be subject to their terms.

Information on the Services is for general purposes only and is not professional legal, medical, financial, or mental-health advice.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. SOME JURISDICTIONS LIMIT THESE DISCLAIMERS; THEY APPLY ONLY TO THE EXTENT PERMITTED THERE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WAIDE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS, ARISING FROM THE SERVICES COVERED BY THESE TERMS.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THOSE SERVICES WILL NOT EXCEED THE GREATER OF (1) WHAT YOU PAID US FOR THE RELEVANT PRODUCT IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (2) ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS LIMIT THESE CAPS; THEY APPLY ONLY TO THE EXTENT PERMITTED THERE.

You agree to indemnify and hold us harmless from claims arising from your misuse of the Services, violation of these Terms, violation of others’ rights, false or unauthorized actions on your account, or your unlawful conduct, to the extent permitted by law.

We may update these Terms by posting a revised version with a new “Last Updated” date. Continued use after changes take effect means you accept the updated Terms.

These Terms are governed by Idaho law. Disputes must be brought in state or federal courts with jurisdiction over Ada County, Idaho, unless applicable law requires otherwise.

If any provision is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement for the Services described in the Agreement section. Waide Academy use is also subject to the Academy Terms of Use and Privacy Policy.
